Welcome to HobbyPlot.com (“HobbyPlot”, “we”, “us”, “our”). These Terms & Conditions (“Terms”) govern your access to and use of the HobbyPlot website, apps, and services (together, the “Service”). By creating an account, ticking the acceptance box, or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. What HobbyPlot is

HobbyPlot is a supporting service for hobby gardeners, growers and small-scale farmers. We provide tools to plan garden beds, learn about plants, keep a growing journal, and connect with other growers — including a community forum and a peer-to-peer marketplace where users may offer and buy seeds, seedlings, produce and garden-related goods.

HobbyPlot is a technology platform and information service only. We help people organise their gardening and find each other. We do not grow, produce, own, inspect, handle, store, ship, or deliver any goods, and we do not provide gardening, agricultural, veterinary, health, legal, or financial advice. Any information in the Service (encyclopedia entries, planting dates, suggestions) is general guidance that may not fit your specific conditions.

2. The Marketplace — our role and responsibility

HobbyPlot is not a party to any transaction between users. The marketplace is a venue that lets independent buyers and sellers find one another. When you buy or sell through HobbyPlot, the contract is solely between the buyer and the seller — not with us.

Accordingly, and to the fullest extent permitted by law:

We do not own, produce, inspect, test, certify, store, package, or deliver any item listed on the marketplace.
We make no warranty or representation about any listing or item — including its quality, safety, health, viability, authenticity, origin, description, legality, fitness for any purpose, or that a seller is able to complete a sale or a buyer to pay.
We are not responsible or liable for the goods sold, for their use or misuse, for any harm, loss, illness, crop failure, or damage arising from them, or for delivery, non-delivery, payment, refunds, disputes, or the conduct of any user.
Listings do not constitute an endorsement or recommendation by HobbyPlot.
Buyers and sellers are solely responsible for their transactions and for complying with all laws that apply to them — including rules on the sale of seeds, plants, protected or invasive species, food, and any licensing, phytosanitary, tax, or consumer-protection requirements.

You are responsible for satisfying yourself about any item and any counterparty before you transact. Where local consumer law gives a buyer rights against a seller, those rights are against the seller, not against HobbyPlot.

3. Eligibility

You must be at least 18 years old (or the age of majority where you live) and able to enter into a binding contract. By using the Service you confirm that the information you give us is accurate and that you will keep it up to date.

4. Your account

You are responsible for your login credentials and for all activity under your account. Keep your password confidential and tell us promptly of any unauthorised use. We may refuse, suspend, or close accounts as described in Section 11.

5. User content

You keep ownership of the content you post (listings, photos, forum posts, journal notes). By posting, you grant HobbyPlot a non-exclusive, worldwide, royalty-free licence to host, display, and distribute that content for the purpose of operating and promoting the Service. You are responsible for your content and confirm you have the rights to post it and that it does not break these Terms or any law.

6. Acceptable use

You agree not to: post false, misleading, unlawful, infringing, or harmful content; sell prohibited or illegally-sourced items; harass or defraud other users; attempt to disrupt, probe, or gain unauthorised access to the Service; scrape or harvest data without permission; or use the Service in any way that breaks applicable law. We may remove content and take action on accounts that breach this section.

7. Subscriptions & payments

HobbyPlot offers a free tier and optional paid subscriptions (currently the “Serious Hobbyist” and “Pro” tiers), billed monthly or yearly at the prices shown on the Subscription page. Paid features are available for the period you pay for. Unless stated otherwise or required by law, payments are non-refundable, and you can cancel or downgrade at any time with effect from the end of your current billing period. We may change prices or tier features on reasonable notice. Where payments are simulated in a demo or test environment, no real charge is made.

8. Intellectual property

The Service itself — its software, design, branding, the HobbyPlot name and logo, and our own content — belongs to HobbyPlot or its licensors and is protected by law. We grant you a limited, personal, non-transferable licence to use the Service under these Terms. You may not copy, modify, or create derivative works from the Service except as the law allows.

9. Third-party links and services

The Service may link to or rely on third-party websites or services we do not control. We are not responsible for them, and your use of them is at your own risk and subject to their terms.

10. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, to the fullest extent permitted by law — including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any information or planting guidance is accurate or suitable for your situation.

11. Suspension & termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or other users. Sections that by their nature should survive termination (including Sections 2, 5, 8, 10, 12, 13 and 15) will continue to apply.

12. Limitation of liability

To the fullest extent permitted by applicable law, HobbyPlot and the person(s) operating it will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, crops, or goods, arising from or related to your use of the Service or the marketplace — even if we have been advised of the possibility of such damages. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited (for example, for death or personal injury caused by our negligence, or for fraud).

13. Indemnification

You agree to indemnify and hold harmless HobbyPlot and its operators from claims, losses, and reasonable costs (including legal fees) arising from your content, your transactions with other users, your use of the Service, or your breach of these Terms or of any law.

14. Changes

We may update the Service and these Terms from time to time. If we make material changes, we will take reasonable steps to notify you (for example, by posting the updated Terms with a new “Last updated” date). Continuing to use the Service after changes take effect means you accept the updated Terms.

15. Governing law & disputes

These Terms and any dispute arising out of or in connection with them or the Service are governed by the laws of the Republic of Serbia, without regard to its conflict-of-laws rules. The courts of [CITY], Serbia will have jurisdiction, except where mandatory consumer-protection law gives you the right to bring proceedings in the courts of your place of residence. Nothing in these Terms affects your mandatory statutory rights as a consumer.
